Forced Birth, Not Choice: When Courts Override Pregnant Patients

In Florida, hospitals have gone to court to force pregnant women into C-sections—even while they were in labor.


Some women were put on emergency calls with judges from their hospital beds, fighting for the right to make decisions about their own bodies in real time.


This isn’t just about medicine—it’s about autonomy.


A C-section is a major surgical procedure. It should never be forced. Yet in these cases, courts overrode patient consent, prioritizing institutional authority over individual rights.


These practices raise serious concerns about:

• patient autonomy

• informed consent

• medical bias

• and the disproportionate impact on Black women and marginalized communities
